Welcome to Visibella ("we," "our," or "us"). Visibella is an AI-powered brand visibility monitoring platform that helps businesses track and analyze their presence across large language models (LLMs) and AI systems.

By accessing or using the Visibella service (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you (either an individual or an entity) and Visibella. Your use of the Service is also governed by our Privacy Policy.

Visibella provides an AI visibility monitoring platform that:

• Analyzes your brand's presence across multiple LLM platforms (OpenAI ChatGPT, Google Gemini, Perplexity, DeepSeek, Grok)
• Generates comprehensive visibility reports and competitive analysis
• Provides dashboard analytics and historical trend tracking
• Offers AI-powered insights through our "Ask Visibella" feature
• Enables organization and team management capabilities

The Service is provided on a subscription basis with various plan tiers. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You may not share your account credentials or allow others to access your account. You are responsible for all actions taken through your account.

4.1 Plan Types

We offer the following subscription plans:

• Snapshot Plan ($39 one-time): 1 one-time deep scan, dashboard results access, 30-day retention, 1 organization
• Core Plan ($149/month): 1 automated scan/week, automatic email reports, full dashboard access, 90-day history retention, 1 organization
• Professional Plan ($399/month): 6 automated scans/week, Ask Visibella AI assistant, automatic email reports, 12-month history retention, 3 organizations, priority support
• Enterprise Plan (Custom pricing): Unlimited automated scans, Ask Visibella AI assistant, automatic email reports, unlimited organizations, unlimited history retention, priority support, custom team features

4.2 Payment Terms

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled. You will be charged the then-current rate for your plan.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

4.5 Refund Policy

Due to the nature of our Service, we generally do not offer refunds. However, we may consider refund requests on a case-by-case basis for technical issues or service failures. Contact support@visibella.com within 7 days of purchase.

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or sublicense the Service
• Use the Service to monitor competitors in violation of their terms
• Exceed the usage limits of your subscription plan
• Upload malicious code, viruses, or harmful content

Violation of this policy may result in immediate suspension or termination of your account without refund.

6.1 Visibella's Rights

The Service, including all content, features, functionality, software, and design, is owned by Visibella and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 Your Data

You retain all rights to the data you input into the Service (organization information, brand details, etc.). By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

6.3 Analysis Results

The analysis results, reports, and insights generated by our Service are provided to you for your internal business use. You may not resell or redistribute these results without our permission.

To provide our Service, we process your data through third-party LLM providers (OpenAI, Google, Perplexity, DeepSeek, Grok). By using the Service, you acknowledge and agree that:

• Your organization and brand information may be sent to LLM APIs for analysis
• We use industry-standard security measures to protect your data
• LLM providers process data according to their own privacy policies
• Analysis results are stored in our secure database (Supabase)
• We do not sell or share your data with third parties for marketing purposes

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE SERVICE
• WE ARE NOT LIABLE FOR THE ACCURACY OF AI-GENERATED ANALYSIS
• WE ARE NOT RESPONSIBLE FOR THIRD-PARTY LLM PROVIDER ACTIONS OR FAILURES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.

9.1 By You

You may terminate your account at any time through your account settings. Upon termination, your access to the Service will cease at the end of your current billing period.

9.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

9.3 Data Retention

Upon termination, we will retain your data according to our data retention policy and legal obligations. You may request data deletion by contacting support@visibella.com.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically. The "Last Updated" date at the top indicates when these Terms were last revised.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Visibella operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or class action.
